By installing, copying, or otherwise using Alistair, you agree to be bound by these Terms. If you do not agree, do not install or use the software.
These Terms of Service ("Terms") constitute a legally binding agreement between you ("You" or "Your") and the publisher of Alistair ("Licensor," "we," "us," or "our") governing your use of the Alistair creative writing software ("Software"), including all associated media, documentation, and future updates.
By installing, downloading, accessing, or using the Software, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction), have read and understood these Terms, and agree to be bound by them. If you are using the Software on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use one (1) copy of the Software on a single computer or device for your personal or internal business purposes.
The Software is licensed, not sold. We retain all right, title, and interest in and to the Software, including all intellectual property rights. These Terms do not grant you any rights to our trademarks, service marks, or trade names.
A valid license key is required to use the full version of Alistair. One license covers one machine. See Section 7 for activation details.
You may not, and may not permit anyone else to:
Alistair includes optional AI and machine learning features that may generate text, suggestions, or other content ("AI-Generated Content"). By using these features, you acknowledge the following:
To the maximum extent permitted by law, we shall not be liable for any damages arising from your use of AI-Generated Content.
You retain all rights to content you create using Alistair, including manuscripts, documents, notes, and other creative works. We claim no ownership of your content.
You are solely responsible for backing up your content. We are not liable for any loss of data or creative works. We strongly recommend maintaining regular backups.
Alistair is available as a free 30-day trial. During the trial period, you may use the full feature set of the Software at no charge. Upon expiration of the trial, you must either purchase a license key or cease using the Software.
We reserve the right to modify trial terms or duration at any time with notice.
A valid license key is required to continue using Alistair after the trial period. Your license key is tied to a single machine and may not be transferred to another device without our written authorisation.
You are responsible for maintaining the confidentiality of your license key. We reserve the right to deactivate license keys obtained through fraudulent means, chargebacks, or in violation of these Terms.
The Software may automatically download and install updates, patches, and feature additions to improve performance, security, or functionality. By using the Software, you consent to automatic updates.
You may disable automatic updates in the Software settings. Doing so may limit functionality or expose your system to security vulnerabilities. We are not liable for issues arising from your choice to disable updates.
Alistair offers optional features that require third-party components not included in the base installation:
All optional components are downloaded directly to your machine and run locally. Any AI model you download from Hugging Face is stored and executed on your device only — no data is sent to our servers during AI processing.
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Software will meet your requirements, that it will operate uninterrupted or error-free, or that defects will be corrected.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, CONSEQUENTIAL, OR PUNITIVE DAMAGES WHATSOEVER, INCLUDING DAMAGES FOR LOSS OF BUSINESS PROFITS, LOSS OF DATA, LOSS OF CREATIVE WORKS, OR ANY OTHER PECUNIARY LOSS.
In any event, our total liability under these Terms shall not exceed the amount actually paid by you for your Alistair license.
You agree to indemnify, defend, and hold harmless Alistair and its owner from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Software, your violation of these Terms, or your violation of any third-party rights.
These Terms are effective until terminated. Your rights will terminate automatically and without notice if you fail to comply with any provision. Upon termination, you must destroy all copies of the Software in your possession.
We may terminate these Terms immediately if you breach any provision. Sections 4, 5, 10, 11, 12, and 14 shall survive termination.
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.
Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Florida, and you consent to personal jurisdiction of such courts.
We reserve the right to modify these Terms at any time. We will make reasonable efforts to notify users of material changes. Continued use of the Software after any changes constitutes your acceptance of the revised Terms.
